Under Section 28 of the National Conservation and Environment Protection Act (NCEPA), Chapter 11.03 ("Beach vested in the Crown with public access"), all rights in and over the beach are declared to be vested in the Crown. The statute establishes a public right of access to and recreational use of beaches, and stipulates that there shall be at least one public landward access to every beach in Saint Christopher and Nevis. Commercial facilities and equipment (such as rented beach loungers, umbrellas, and private resort amenities) remain private property.
Ocean conditions, wave energy, and water clarity vary with weather, seasonal groundswells, and prevailing trade winds. Visitors are advised to evaluate sea conditions prior to swimming, observe posted local flags or advisory notices where present, and exercise personal caution and discretion in open water.
